The Trump Administration appears to be moving policy in the opposite direction. A June 2026 federal reorganization illustrates the increasingly blurred boundary between education, health care, and developmental assistance. The Trump administration announced an interagency agreement under which the Department of Health and Human Services will assume substantial responsibility for administering federal special-education and rehabilitative-service programs. HHS will assist with grant administration, compliance, monitoring, data collection, and future awards, although the Department of Education states that it will retain the statutory authority assigned to it under the Individuals with Disabilities Education Act.

The change has prompted concern that children with disabilities will increasingly be viewed as patients with medical conditions rather than students entitled to an appropriate education. A freely accessible Associated Press report describes the objections raised by families and disability advocates. The administration’s official announcement emphasizes coordination and states that existing legal protections will remain in place.
